Rupinder Singh, Executive Vice President of Datawind Innovations Pvt. Ltd. (respondent no. 2/complainant) is present in Court along with his counsel.
He submits that matter has been settled during the arbitration proceedings and a consent award dated 2nd April, 2018 has also been passed by Mr. Arif Bookwala, learned Arbitrator. Photocopy of the consent award is placed on record and perused. He further submits that settled amount has already been received by the respondent no. 2. Mr.
Rupinder Singh, Executive Vice President further submits that respondent
no. 2 has no objection in case FIR No. 632/2015 under Sections 406/409/420/467/468/471/34 IPC registered at Police Station K.M. Pur and the consequent proceedings emanating therefrom are quashed. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
