Bail Appln.2757/2018 & Crl.M.A. 47905/2018 Learned counsel for the petitioner submits that he has not been named as an assailant in the FIR. Petitioner was not even present at the spot and no recovery has to be made from him.
Keeping in mind the totality of the facts and circumstances of this case, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `20,000/- (Rupees Twenty
Thousand Only) with one surety in the like amount to the satisfaction of Arresting Officer/ Investigating Officer/Station House Officer of the concerned police station.
Petitioner shall, however, cooperate in the investigation and appear before the Investigating Officer on 27.11.2018 at 04:00 p.m. The petitioner shall also appear before the Investigating Officer on any other subsequent date(s) if he is called upon for the investigation. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
