CORAM:

JUSTICE S.MURALIDHAR JUSTICE I.S.MEHTA

O R D E R

% 09.11.2017

1. On 11th October, 2017, the following order was passed by this Court: "Status report has been handed over in Court detailing steps taken to recover Akansha Gupta, the missing daughter of the petitioner, who has married Faizal @ Deepak. The status report also reveals that the marriage certificate issued by Arya Samaj Mandir, Prayag, Allahabad, Uttar Pradesh has been verified and found to be genuine.

We may also note that Akansha Gupta and Faizal had approached the Allahabad High Court by filing a writ petition seeking

protection. Copy of the order has been placed on record with the previous status report.

Mr. Mehra submits that efforts would continue to be taken to trace the missing daughter of the petitioner. Counsel, on instructions from the petitioner, submits that the petitioner and her family has no objection to the marriage and her daughter and Faizal should approach the family and seek their blessings as they are only concerned about their wellbeing. List on 09.11.2017".

2. In view of the above order, the Court is of the view that there is no need to keep this petition pending. The purpose of a habeas corpus petition is to ensure that the person stated to be missing is safe and secure and not under any unlawful restraint. That purpose having been served, as is evident from the above order, the Court sees no purpose being served to keep the present petition pending. The Petitioner is at liberty to seek redressal of any other grievance that she may have in other appropriate proceedings.

3. The petition is disposed of.
