% 13.12.2017 This petition seeks quashing of FIR No. 182 of 2017 u/s 308 IPC regarding a quarrel and assault at P.S. Nand Nagri, Delhi which was registered on the complaint of respondent No. 2 viz. Mr. Chand son of Mr. Bhura.
The complainant has since compromised his lis with the petitioner and does not wish to proceed with the complaint any further. In this regard, a copy of his letter addressed to the police has been attached to the petition. The incident happened on 28.03.2017 and the dispute was resolved within 24 hours of the incident i.e. on 29.03.2017 with the assistance of their neighbours and well wishers. The learned counsel for the complainant submits that the complainant indeed desires that the FIR be quashed. A copy of identify proof of the petitioner has been taken on record.
In view of the above and since the complainant himself does not wish to proceed with the matter, no useful purpose will be served by keeping the FIR alive and any further proceedings arising therefrom would be an exercise in futility.
In the circumstances, FIR No. 182/2017 under section 308 IPC P.S. Nand Nagri and all proceedings emanating therefrom are hereby quashed.
The petition is allowed in the above terms.
