% 20.02.2019 Impugned order of 31st August, 2017 imposes costs of ₹1,00,000/- while allowing petitioner's application under Section 311 Cr.P.C. Although there is no challenge to the impugned order but waiver of costs is sought by learned Special Public Prosecutor for CBI/petitioner. Upon hearing, I find that the costs have been imposed upon petitioner because the additional evidence is sought to be led after ten years of filing of charge-sheet. Since respondents-accused are on bail, therefore, there is no justification to impose the costs. In the facts and circumstances of this case, the cost imposed is reduced from ₹1,00,000/- to ₹10,000/-. Let the modified cost of ₹10,000/- be deposited by petitioner-CBI in Prime Minister's National Relief Fund within four Page | 1
