% 27.09.2017 C.M. No.35478/2017 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(C) 8636/2017 The only submission of learned counsel for the petitioner is that the tribunal while deciding the R.A. No.153/2017 did not consider the primary submission of the petitioner premised upon the additional documents filed by the petitioner, namely, the muster roll of the employment exchange dated 30.06.2004. According to the petitioners, they had been engaged in a transparent manner through competition and their names were sponsored by the employment exchange.

From the order passed on the review application, it appears that the said aspect did not receive the tribunal's consideration. Counsel for the respondent, who appears on advance notice, cannot dispute this position either.

In view of the aforesaid, the order dated 19.07.2017 passed in the review application is set aside and the review application is remanded back to the tribunal for reconsideration. Since the review application was disposed of without notice to the respondent, the respondents are now granted time to file response thereto within two weeks. List the matter before the tribunal on 24.10.2017. No further notice shall be required to be given to the parties. Dasti.
