% 26.09.2017 By the petitioner, the petitioner assails an order dated 23.8.2017 purportedly reserving the orders in a revenue case by Dy.

Commissioner (South), which is as under :

"Adv. for John Nagar Appellant appeared before me. Filed rejoinder.

Copy also served to objector.

However, none appeared for objector's side. I have heard enough from both the parties. Without further lingering on the matter can be decided with the details and documents on record. However an opportunity be extended to objector in the case be file any additional documents if any.

Rejoinder they can very well file within 15 days from today. Order is reserved." Mr. Singh, ld. counsel for the respondent submits that he has instructions to state that D.C. (South) shall give a fresh hearing for the petitioner, as prayed for.

In view of the aforegoing, the instant petition is disposed off with a direction to the D.C. (South) to give a hearing to the petitioner on 23.10.2017 at 3.30 p.m.

It shall be the prerogative of the D.C.

(South) to adjourn the matter for further hearing, if, so required, and then, pass a speaking order.

Petition and the pending applications disposed off accordingly.
