This petition under Article 227 of the Constitution of India seeks expeditious disposal of application filed by the respondent for leave to defend the petition for eviction under Section 14(1)(e) of the Delhi Rent Control Act, 1958 being E No.64/2015 (New No.E-79218/2016) titled Smt. Har Devi Vs. M/s BFC Traders filed by the petitioner on or about 19th May, 2015 and pending in the Court of Additional Rent Controller (ARC) (Central), Tis Hazari Courts, Delhi.

The legislature, by granting only fifteen days time for filing of leave to defend, has disclosed legislative intent of expeditious disposal of such petitions for eviction and the petition for eviction has indeed remained pending at the stage of leave to defend for unusually long time of nearly two and a half years since the institution thereof. 3.

The counsel for the petitioner, on enquiry, states that the matter is now listed next on 28th November, 2017 for arguments on the application for leave to defend.

On the undertaking of the counsel for the petitioner that he will not take any passover/adjournment, the learned ARC (Central), Tis Hazari Courts, Delhi is directed to hear arguments on the application for leave to defend in E No.64/2015 (New No.E-79218/2016) titled Smt. Har Devi Vs. M/s BFC Traders on 28th November, 2017 and to dispose of the application for leave to defend on or before the end of the year 2017. 5.

The petition is disposed of.
