% 13.02.2019 1.
Vide the present petition, the petitioner/management has impugned the Award dated 17th February, 2014, passed by the learned Labour Court No.III, Karkardooma Courts, Delhi in DID No.514/06/05, whereby the petitioner has been directed to pay a sum of Rs.2,50,000/- to the respondent in lieu of reinstatement. 2.
On the last date, the petitioner had in order to amicably settle the matter, made an offer to pay a sum of Rs.1,25,000/- to the respondent in lieu of all his claims against the petitioner when the learned counsel for the respondent had sought time to obtain instructions.
3.
Today, learned counsel for the respondent on instructions from
the respondent states that the said offer is acceptable to the respondent. He, however, states that since the petitioner has already deposited a sum of Rs.1,00,000/- before this Court pursuant to the order dated 27th September, 2017, the petitioner may be directed to pay the balance sum of Rs.25,000/- to the respondent/workman within four weeks along with upto date accrued interest. The said offer is acceptable to the learned counsel for the petitioner. 4.
Accordingly, the writ petition is disposed of in terms of the above settlement. The Registry is directed to forthwith release the amount as deposited along with interest accrued thereon in favour of the respondent/workman immediately. The petitioner prays for and is granted time to pay a further sum of Rs.25,000/- as agreed, to the respondent within a period of four weeks.
5.
The parties will remain bound by the terms of the aforesaid settlement.
6.
Needless to state that in view of the aforesaid settlement, the impugned Award will no longer be enforceable. 7.
The petition is disposed of in the aforesaid terms. REKHA PALLI, J FEBRUARY 13, 2019/aa
