% 17.01.2018 The learned counsel for the respondent submits that respondent company made panel of arbitrators and any one of them can be appointed as an arbitrator in this matter, which is refuted by the learned counsel for petitioner.

In the circumstances while terminating the mandate of earlier nominated arbitrator, the parties are referred to Delhi International Arbitration Centre (DIAC) for appointment of an arbitrator. The arbitration shall take place under the aegis of DIAC and the arbitration fees shall be in terms of the DIAC Rules. Parties to appear before the Additional Coordinator, DIAC on 05.02.2018.
