O R D E R

% 15.02.2017 This is a petition under Section 482 Cr.P.C. moved by the petitioners for quashing of FIR No.6/2012, under Sections 420/467/471/34 IPC, registered at Police Station Hauz Khas.

It is submitted by learned counsel for the petitioners that the petitioners were the employees of the collection agent of respondent No.2 bank- Royal Bank of Scotland. He further submits that in the process of collection, the misunderstanding between the parties has arisen, which resulted into registration of the said FIR. He also submits that since the matter was among the three parties i.e. petitioners, respondent No.2 and the Collection Agent, the amount so collected was deposited with the respondent No.2 bank and the matter has been solved amicably and that

nothing remains to be adjudicated upon further. He also submits that since the present FIR is coming as a hurdle in the future life of the petitioners, the present FIR may be quashed.

Mr.Ankur Khurana, Assistant Vice President (Controls), Royal Bank of Scotland is present and submits that he is authorized to make statement on behalf of respondent No.2. He also submits that power of attorney to this effect has already been filed. He admits that the matter has been amicably resolved with the petitioners and that an affidavit to this effect has already been filed. He further submits that the respondent No.2 has no objection, if the present FIR is quashed.

Keeping in view the facts and circumstances, since the matter has been amicably settled between the parties and nothing is to be adjudicated further, I deem it appropriate to quash the FIR in question. Consequently, to meet the ends of justice, the FIR No. 6/2012, under Sections 420/467/471/34 IPC, registered at Police Station Hauz Khas and all subsequent proceedings arising therefrom are hereby quashed.

The petition stands disposed of accordingly.

Copy of this order be given dasti, as prayed. TCR be sent back.
