By way of this application filed under Section 438 Cr.P.C. the petitioner is praying for grant of anticipatory bail in case FIR No.101/2017 under Section 420 IPC, Barakhamba Road.

Learned APP for the State submits that the petitioner has joined the investigation and he is no more required for custodial interrogation. 3.
In brief, the case against the present petitioner is that he approached the complainant and represented himself to be the Director of M/s Royal Arabian Foods (LLC), Dubai and impressed the complainant that he was sourcing Sella Rice for M/s Royal Arabian Foods (LLC) and by mail dated 11.01.2017 he had placed an order of 240 MT Sella Basmati Rice amounting to ₹52,22,400/- and the rice was supplied to them. As per the terms and BAIL APPLN. 1974/2017
conditions of the contract 10% payment was made which was to be made against the B/L. Thereafter, accused persons avoided making rest of the payment.

Taking into consideration the facts and circumstances and the allegations that the petitioner allegedly received 10% of the total invoice amount, subject to deposit of ₹5,00,000/- by the petitioner with the Registrar General of this Court within one week, in the event of arrest the petitioner shall be released on bail on his furnishing personal bond in the sum of ₹50,000/- with one surety of the like amount to the satisfaction of concerned IO/SHO.

The amount so deposited shall be kept in a Fixed Deposit Receipt with UCO Bank, Delhi High Court Branch in the name of the Registrar General of this Court initially for a period of one year, subject to auto renewal facility, if necessary.

The amount so deposited with interest accrued thereon shall be released to the petitioner or complainant subject to the outcome of the trial in case FIR No.101/2017 under Section 420 IPC, Barakhamba Road, Delhi. 7.
The bail application is allowed in above terms. As prayed, copy of the order be given dasti to learned counsel for the parties.
