% 15.11.2018 Learned counsel for petitioner submits that sec. 497 IPC has been declared unconstitutional by the Supreme Court vide judgment dated 27th September, 2018 passed in WP (Crl.) 194/2017. He says that, in view thereof, criminal complaint filed by respondent no.2 before the trial court may be quashed.
Learned counsel for complainant submits that the complainant has no objection in case the complaint case is quashed. Accordingly, criminal complaint is quashed.
Petition is disposed of in the above terms.
