CORAM:
HON'BLE MR. JUSTICE JAYANT NATH
O R D E R
% 27.09.2017 1.
This petition is filed under Section 29A of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as the Act) seeking to extend the time by a period of 12 months for the making of the award. 2.
Pursuant to the invocation of the arbitration clause by the petitioner, an Arbitral Tribunal was constituted on 21.04.2016. On 23.01.2017, the parties recorded their consent to extend the time period for making of the award by a period of six months from April 2017 under Section 29A(3) of the Act. The said extended period of six months is also going to expire by 21.10.2017. It is averred in the petition that the arbitral record is a bulky record inasmuch as the even the claim petition filed by the petitioner is running into eight volumes. Total 13 hearings have been held by the Tribunal.
3.
Four witnesses of the claimant/petitioner have been examined and the evidence of the petitioner is now closed.
4.
Learned counsel for the respondent has entered appearance. She submits that she has no objection to the grant of extension. 5.
Accordingly, the petition is allowed. The time for making of the award is extended by 12 months w.e.f. 21.10.2017. JAYANT NATH, J SEPTEMBER 27, 2017 rb
