Against penalty of compulsory retirement, petitioner had preferred an appeal (Annexure P-12) which according to petitioner is still pending. Upon notice, learned counsel for respondents submits that if petitioner's appeal (Annexure P-12) has not been decided till date, the same would be definitely decided within a period of 8 weeks.

In view of the aforesaid, the petition is disposed of with a direction to respondents to convey the fate of the appeal (Annexure P-12) to petitioner if it is already decided and if not decided, then to do so within a period of 8 weeks by passing a speaking order and after affording opportunity of W.P.(C) 9705/2017

hearing to the petitioner in the appeal. Needless to say, the fate of the appeal shall be made known to the petitioner within a week after the appeal is decided, so that petitioner may avail of the remedy as available in law 3.
