O R D E R

% 03.11.2017 This petition seeks quashing of FIR No. 0405/2016 P.S. North Rohini, Rohini/Outer District, Delhi filed under Sections 420/406/506 of the IPC apropos a property dispute between the parties. The learned counsel for the parties submit that the dispute has since been settled amicably by way of MOU dated 23.08.2017. The MOU has been signed by the parties concerned i.e. the petitioners and respondent no.2 herein. The parties are present in Court and have been identified by their counsel. They state that they stand by the settlement and shall abide by the same. Since the complainant himself does not wish to pursue the case any further in view of the settlement, no useful purpose will be served by keeping the FIR alive, even notionally.

Further investigation and trial, if any, of the case will be an exercise in futility.

In view of the above, the writ petition is allowed and the FIR bearing No. 0405/2016 P.S. North Rohini, Rohini/Outer District, Delhi and all proceedings arising therefrom are quashed.

The petition is disposed off accordingly.
