CRL.M.C. 4045/2017 This is a petition under Section 482 Cr.P.C seeking setting aside of order dated 10.03.2017 passed by learned Metropolitan Magistrate (Mahila Court)/NE/Karkardooma Courts, Delhi in FIR No.257/2016, registered at Police Station-Gokulpuri, Delhi whereby the petitioner has been declared as Proclaimed Offender.
Learned counsel for the petitioner has submitted that the petitioner is an innocent person having no nexus with the FIR No.257/2016, registered at Police Station-Gokulpuri, Delhi. Learned counsel for the petitioner has
submitted that the petitioner had no knowledge about registration of the aforesaid FIR. He has further submitted that the petitioner is ready to join investigation and surrender before the Court and the petitioner is ready to abide by all the terms and conditions which is imposed by this Court. Learned APP for State has opposed the contention of learned counsel for the petitioner.
Keeping in view the facts and circumstances of the case, the petitioner is directed to surrender before the concerned Court on or before 09.10.2017 and move appropriate application for bail. In the meantime, in the event of his release, the petitioner be released on bail on his furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the concerned Court below.
The present petition is disposed of accordingly.
