% 09.10.2017 This is a worthless appeal. After some hearing, learned counsel for the appellants seeks liberty to withdraw the appeal and states that the other remedies may be kept open. It is also requested that the observations made in the course of the impugned order should not be treated as conclusive. Liberty granted.
The Court also clarifies that the observations of the learned Single Judge are not to be treated as conclusive in case the appellants avail of other remedies.
The appeal is accordingly dismissed as withdrawn along with the pending application.
