JUDGMENT

26.11.2018 SANJEEV SACHDEVA, J. (ORAL) 1.

Petitioner seeks anticipatory bail in FIR No.420/2017 under Section 354(B)/506/509/323 IPC, Police Station Seemapuri. 2.

Subject FIR was registered on the complaint of the wife of the petitioner. The parties were married in September, 2009 and since January, 2012 have been living separately. The allegations in the FIR are that petitioner had come to the clinic of the complainant and threatened her to withdraw all cases filed by her against him.

Petitioner is also alleged to have misbehaved with the complainant consequent to which the complaint was made and subject FIR has been registered. It is stated that matrimonial disputes are also pending and BAIL APPLN. 1973/2017

proceedings have been initiated for divorce.

Petitioner was granted interim protection by order dated 27.09.2017 subject to joining investigation.

Learned APP under instructions from the IO submits that initially petitioner had not joined investigation, however, after the orders of the Court, petitioner joined investigation. Investigation is nearly complete and charge sheet is in the process of being finalised for being filed in Court. 6.

Keeping in view the facts and circumstances of the case and without commenting on the merits of the case, and on perusal of the records, I am satisfied that the petitioner has made out a case for grant of anticipatory bail.

Accordingly, it is directed that in the event of arrest, the arresting officer/IO/SHO shall release the petitioner on bail on his furnishing a bail bond in the sum of Rs. 15,000/- with one surety of the like amount to the satisfaction of the arresting officer/Investigating Officer/SHO concerned. Petitioner shall not do anything that may prejudice either the investigation, trial or the prosecution witnesses.
