The petitioner has filed the present petition, inter alia, praying that respondent no.1 be restrained from providing any information regarding the petitioner to respondent no.2. It is seen that the petitioner and respondent no.2 are husband and wife and some litigation pending between them; the petitioner states that respondent no.2 (who is the wife of the petitioner) has sought maintenance for her and the minor children. It is in this regard that respondent no.2 has sought for information regarding the emoluments and other perks provided by respondent no.1 to the petitioner. 2.

In these peculiar facts, this Court is not inclined to entertain the present petition as this Court is of the view that in any event - that is, even if the recourse to the Right to Information Act, 2005 is not available to respondent no.2 - respondent no.2 would, nonetheless, be entitled to the information sought for by her to prosecute the proceedings pending between the parties.
