HON'BLE MR. JUSTICE NAVIN CHAWLA
O R D E R
% 15.01.2018 Counsel for the petitioner is relying upon the purported arbitration agreement that is contained on the reverse side of the invoices issued by the petitioner to the respondents.
Admittedly there are 19 of such invoices, which are subject matter of the present petition. Counsel for the respondents submits that, without admitting that there is an arbitration agreement between the parties, as there are 19 different invoices, each would in any case amount to a separate arbitration agreement and one consolidated petition would, therefore, not be maintainable.
In view of the objections raised by the counsel for the respondents, the counsel for the petitioner seeks leave to withdraw the present petition, with liberty to file appropriate petitions.
The petition is dismissed as withdrawn with liberty as prayed for. NAVIN CHAWLA, J JANUARY 15, 2018 rekha
