This appeal is allowed with consent order that the subject suit filed by the respondent/plaintiff will be treated as an ordinary suit and tried as an ordinary suit and not under Order 37 of Code of Civil Procedure, 1908 (CPC). Impugned judgment of the trial court is therefore set aside and it is directed that the suit will now be tried as an ordinary suit. 2.
