% 05.12.2018 Notice.

Learned APP accepts notice for respondent nos. 1 and 2. Respondent nos. 3 to 6, namely, Yogendra, Suman, Anil Kumar Jha and Vivek Kumar are present in Court along with their counsel and accept notice. They have been identified by ASI Balvinder Singh of police station Sangam Vihar.

It is submitted that petitioners, namely, Umeshkant, Bindu Devi, Ravikant, Deepak and Rohit Singh and respondent nos. 3 to 6 are neighbours.

A quarrel took place between them on some trivial issues, which led to the incident, resulting in registration of FIR no. 427/2017 under

Sections 308/34 IPC at police station Sangam Vihar on the complaint of respondent no. 5 Anil Kumar Jha. With the interventions of their common friends and other family members, petitioners and respondent nos. 3 to 6 have settled their disputes amicably, vide a Memorandum of Understanding dated 12th November, 2018. Respondent nos. 3 to 6 admit having settled the matter with petitioners of their own free will, voluntarily and without any undue force, pressure or coercion and they have no objection in case aforesaid FIR and consequent proceedings emanating therefrom are quashed against the petitioners.

Keeping in mind the settlement arrived at between the petitioners and private respondents voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
