% 24.09.2018 The counsel for the petitioners, on instructions, submits that since the criminal complaint case (CC 51/01) instituted by the first respondent is still at the stage of pre-charge evidence, this petition and the application filed therewith may be permitted to be withdrawn, the petitioners reserving the right to raise all the contentions set out in the petition after completion of the pre-charge evidence to seek discharge. The contentions of the parties are kept open. The petition challenging the dismissal of the application for discharge under Section 245(2) Cr. PC alongwith the application filed therewith are dismissed as withdrawn, the right of the petitioners to seek discharge after completion of the pre-charge evidence having been reserved.
