It is submitted by Mr. Mohsin Israily, learned counsel for the petitioner, on instructions of Mr. Subhash Shukla that he has filed a vakalatnama for the petitioner today. He makes a prayer, on instructions from the petitioner that he may be permitted to withdraw this writ petition which was claimed to be filed in public interest on the ground that Mr. Subhash Shukla has entered into a settlement with the private respondents.

Mr. Gaurang Kanth, learned counsel for the EDMC disputes the bonafide in filing the petition pointing out that the petitioner appears to have resorted to filing the petition in order to blackmail the private respondents and that the petitioner has entered into a

settlement with the person, against whose construction he had complained.

It cannot be denied that valuable judicial time has been wasted on this matter. We are also not satisfied with the bonafides of the petitioner and this litigation.

In view of the above, this writ petition is dismissed as withdrawn subject to payment of costs of Rs.25,000/- which shall be deposited with the Delhi High Court Legal Services Committee within a period of four weeks from today. Proof of deposit shall be filed in the Registry. In case, costs are not deposited, the Registry shall list this matter before court for orders. 5.

We are informed by Mr. Israily that he appears for Mohd. Rahees Qureshi (respondent no.3 in this petition) and that he has filed W.P.(C) 5802/2017 on behalf of Mohd. Rahees Qureshi against Subhash Shukla, the present petitioner. It is submitted that in view of the settlement, Mohd. Rahees Qureshi would also be withdrawing the writ petition on the next date of hearing. Let a copy of this order be placed on the record of W.P.(C) 5802/2017. 6.

Copy of this order be also sent to the Delhi High Court Legal Services Committee.
