% 26.10.2017 In view of order dated 26.10.2017 of the Acting Chief Justice the case has been assigned to this court from the Court of Anu Malhotra, J. as she is on leave today.

Learned counsel for the petitioner seeks anticipatory bail. However, learned APP for State submits that the chargesheet has been filed without arrest of the petitioner. Learned APP for State further adds that in fact the petitioner has been placed in column No.12.

In these circumstances, the counsel for the petitioner is allowed to withdraw the present application with liberty to move an application before court concerned who shall hear the same on merits.

In view of above, nothing further remains and the present petition stands disposed of.
