% 15.12.2017 Considering that the mobile phone of the deceased was recovered at the instance of the appellant and that the complainant identified the petitioner to be the third accused involved in the FIR though the said statement was made under Section 164 Cr.P.C, this Court finds no ground to suspend the sentence of the appellant at this stage. Petition is dismissed.
