O R D E R

% 27.09.2017 It is submitted that petitioner through his wife has settled the matter with the respondent nos. 2 and 4 before the Mediation Centre, Saket Court, New Delhi on 17th August, 2017 vide Annexure P-4, therefore, it is prayed that FIR No. 128/2017 under Sections 419/420/467/468/471 IPC registered at police station Malviya Nagar and the consequent proceedings emanating therefrom may be quashed.

It is pointed out that FIR was registered on the complaint of respondent no.2.

Respondent nos. 3 and 4 have surfaced during the pendency of the investigation. It is further submitted that wife of petitioner had also agreed before the Mediation Centre that dues of respondent no. 2 shall also be settled. Matter has been settled for a total sum

of `52 lacs out of which `23 lacs was to go to the respondent no.2 and `8 lacs to the respondent no. 4. It was also noted that respondent no. 3 had already received `21 lacs.

Respondent nos. 2 to 4 are present in Court and have been identified by SI Rajender Singh of police station Malviya Nagar. They submit that entire settled amount has been received by them, therefore, they are not willing to pursue the FIR any further and the same may be quashed. Keeping in mind the settlement arrived at between the petitioner and the private respondents and the fact that disputes are civil in nature, in the interest of justice, FIR No. 128/2017 under Sections 419/420/467/468/471 IPC registered at police station Malviya Nagar and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.
