% 27.01.2016 The affidavit of undertaking dated 03.12.2015 on behalf of petitioner has been filed.

The said undertaking filed on behalf of petitioner is not complete as the undertaking to vacate the premises on or before 30.11.2017 has not been mentioned therein. Further, the affidavit of acceptance of undertaking on behalf of Respondent has also not been filed.

Counsel appearing for the Respondent states that the same was not filed as the petitioner has not paid the first instalment of arrears of rent which was to be paid on 01.01.2016 and has also not supplied the copy of the undertaking which has been filed on behalf of petitioner.
