CORAM:

HON'BLE MR. JUSTICE S.P.GARG

% 04.04.2018 1.

Present petition has been filed by the petitioner to transfer her complaint case under Section 138 N.I.Act against respondent No.2 presently pending before Patiala House Courts to Dwarka Courts where her another case under Section 138 N.I.Act is listed for adjudication before the Court of Ms.Upasna Satija, learned M.M. 2.

Notice of the petition was issued to the respondent No.2; he opted not to appear.

3.

I have heard the learned counsel for the petitioner and have examined the file. A complaint case No.12706/2017 under Section 138 N.I.Act lodged by the petitioner against respondent No.2 is pending at Dwarka Courts where summons have been issued to the respondent.

Another complaint case No.9175/2017 again under Section 138 N.I.Act is listed at Patiala House Courts where the respondent No.2 has been summoned.

4.

The petitioner has filed a criminal complaint case under Section 200 Cr.P.C. vide CC No.17946/2017 for alleged threats extended by the respondent No.2 to her.

The said case is also pending at the Dwarka Courts.

5.

It is informed that the petitioner is in service in Gurugram and it is convenient for her to attend the cases at Dwarka Courts. 6.

Since both the matters under Section 138 N.I.Act pertain to the same parties, in the interest of justice and to avoid inconvenience to the petitioner, the complaint case No.9175/2017 presently pending at Patiala House Courts is ordered to be transferred to the Court of Ms.Upasna Satija / Successor Court, Dwarka Courts for disposal as per law.

7.

The transfer petition stands disposed of.
