CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 24.01.2018 It is submitted that respondent no. 3 is daughter of respondent no. 2. FIR No. 196/2014 under Section 363 IPC was registered at police station Anand Parbat on the complaint of respondent no. 2, wherein respondent no. 2 alleged that her daughter aged about 15 years was missing from the house since 10th May, 2014. Subsequently, offences under Sections 324/366/506 IPC and Section 12 of the POCSO Act was added. Respondent no. 3 is now major. It is submitted that petitioner and respondent nos. 2 and 3 have settled their disputes amicably, vide a Memorandum of Understanding/Compromise Deed dated 26th September, 2017; therefore, aforesaid FIR and the consequent proceedings emanating therefrom may be quashed.

Respondent nos. 2 and 3 are present in

Court and have been identified by SI Shiv Prakash of police station Anand Parbat. Respondent nos. 2 and 3 admit having received the settled amount of `50,000/-. Respondent nos. 2 and 3 submit that they have settled the matter with the petitioner of their own free will and without any undue force, pressure or coercion and they have no objection in case the FIR is quashed. Keeping in view the settlement arrived at between the petitioner and respondent nos.2 and 3 voluntarily, in my view no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 196/2014 Sections 324/363/366/506 IPC and Section 12 of the POCSO Act registered at police station Anand Parbat and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
