% 02.05.2018 The petitioners were impleaded as third and first respondents respectively in the case (E. No.5495/2016, old No.73/2015) instituted by the respondents in which the impugned order dated 21.04.2017 was passed. The array of parties before the additional rent controller included three other respondents, viz., Rakesh Kumar Mittal, Rajesh Mittal and Anjali Mittal, who have not been impleaded in these proceedings. The defect of non-joinder came to the fore on 22.11.2017 when the counsel for the petitioner sought adjournment so that he could move an application to implead the parties who have been left out. No application has been filed till date.

The petition is dismissed as defective on account of non-joinder. The pending application are rendered infructuous and accordingly stand disposed of.
