% 15.09.2020 Hearing has been conducted through Video Conferencing. C.M. No. 22652/2020 This is an application filed by the Petitioner seeking permission to withdraw the writ petition.

It is averred in the application that the writ petition was filed by the Petitioner for directions to quash the letter/order dated 27.05.2017 issued by Respondent No. 1 terminating the lien of the Petitioner as well as a Writ of mandamus to grant lien to the Petitioner on the post held by him while relieving him from the Office of Respondent No. 1 and to repatriate him to his parent department i.e. the Office of Respondent No. 1 as also to consider his appointment to the post of Assistant Account Officer with all consequential benefits.

Mr. Rajat Aneja learned counsel for the Petitioner submits that while the pleadings are complete but the relief sought in the petition has now

become infructuous inasmuch as after the order dated 06.01.2014 passed by this Court in W.P. (C) No. 7922/2010 and the subsequent order dated 02.05.2014 in another petition being W.P. (C) No. 2273/2014 titled "Raj Tilak and Others v. District and Sessions Judge and Others", Respondent No. 1 had appointed certain District Court employees on regular basis and they have been promoted by Respondent No. 1 from Pay Level-8 to Pay Level-9. The appointed employees are junior to the Petitioner herein. As a result of these appointments and the consequent promotions to the posts of Assistant Account Officer, Petitioner has lost his seniority in the Accounts Cadre and no purpose will be served in pursuing and prosecuting the present petition.

Issue notice.

Mr. N.K. Singh, Advocate accepts notice on behalf of Respondent Nos. 1 & 2. He submits that he has no objection to the withdrawal of the writ petition.

For the reasons stated in the application, the application is allowed. Petitioner is permitted to withdraw the present petition. W.P. (C) 9196/2017 In view of the order passed in the C.M. 22652/2020, writ petition is disposed of as withdrawn.
