% 27.09.2017 Petitioner-Baby Ruhi, only about 6 days of age, has approached this court through her maternal grandmother being the guardian, her mother being bed ridden for having delivered the petitioner through cesarean section, for medical treatment under EWS category, in terms of the conditions of land allotment to hospitals/nursing homes, with regard to the treatment of poor and indigent persons and in that regard, reliance is placed upon the directions given by the Division Bench of this Court in WP(C) 28661/2002 Social Jurist vs. GNCT Delhi.

It comes to be stated that the mother of the minor is a housewife and on account of matrimonial dispute, the father is not coming forward to discharge his own legal and moral responsibilities and that, the maternal grandparents are poor and indigent persons. Mr. Agrawal, ld. counsel for the respondent, on his part, submits that he

has already received instructions to state that for the medical treatment of the petitioner Baby Ruhi, her maternal grandparents may contact Dr. Hem Prakash, Addl. Director (EWS) Delhi Health Services, F-17, 6th Floor, Karkardooma, Delhi-110032 tomorrow at 10:30 a.m. and he has been directed to ensure the admission of the petitioner Baby Ruhi in one of the Multi Speciality Hospitals as would be appropriate for her further medical treatment, preferably, with Max hospital, Patparganj or Shanti Mukand Hospital on Vikas Marg, under the EWS category. In view thereof, let the grand parents of Baby Ruhi, contact Dr. Hem Prakash and he shall do the neeful, as stated by Mr. Aggarwal.

The grand parents of the petitioner Baby Ruhi shall fulfil the necessary formalities to avail the EWS benefits from the hospital, to which, Baby Ruhi gets admitted on instructions of Dr. Hem Prakash. It is however, made clear that the concerned hospital, to which Baby Ruhi is referred for treatment by Dr. Hem Prakash, shall not refuse her admission and treatment in the absence of fulfilment of the formalities, which may take time, and the treatment should be started immediately on admission, as and when directed by Dr. Hem Prakash.

Petition stands disposed off accordingly.
