O R D E R

% 19.11.2015 CM 22885/2015 This is an application under Order 23 Rule 3 read with Section 151 of the Code of Civil Procedure, 1908, seeking a decree in terms of the settlement agreement arrived at between the parties on 11.09.2015, which has been annexed as 'Annexure-A' to this application. The application, including the annexure, is marked as 'Exhibit C-1'. We have examined the settlement agreement and are of the view that it is in accordance with law. The appellant/ plaintiff is represented by Mr Pravin Anand and the respondents/defendants are represented by Mr Satyanarayana Reddy, who is the respondent No. 1.

They are also represented by Mr Shambo Nandy, Advocate. It is stated by the counsel for the parties that they have also signed this application under Order 23 Rule 3.

They also confirmed that the application was signed by Mr Satyanarayana Reddy and Col. J. R. Sharma (Retired), as indicated in the application.

The settlement agreement, which is 'Annexure-A' to the application has been signed by Mr Aasish Somasi on behalf of the appellant/ plaintiff and by Mr Satyanarayana Reddy on behalf of the respondents/ defendants. Both Mr Aasish Somasi and Mr Satyanarayana Reddy are present in Court and confirmed the said settlement. Decree be drawn up in terms of paragraphs 1 to 6 of the settlement agreement. The application is allowed. The decree be drawn up, as directed above.

FAO(OS) 512/2015 & CM 18810/2015 The appeal as well as the suit stand decreed. The order dated 03.09.2015 passed by the learned Single Judge is set aside.
