% 27.09.2017 This petition is listed vide a supplementary list circulated post lunch session, on a mentioning made before the Hon'ble Acting Chief Justice. W.P.(C) 8835/2017, CM No.36052/2017 The present petition has been filed with the following prayers: "It is therefore, most respectfully prayed that this Hon'ble Court may graciously be pleased:

(i) To issue certiorarified mandamus to call for the entire record relating to charge sheet dated 15.12.2016 issued by the Respondent No.1 to the Petition including the investigation report dated 22.11.2016 submitted by the Respondent No.7 to 9 pursuant to the directions issued by the Respondent No.1 in connection with

allegation contained in the anonymous complaints against the Petition and quash the same, as vitiated.

(ii) Or pass such other or further order as this Hon'ble Court may deem fit & proper in the facts and circumstances of the case."

Learned counsel for the petitioner concedes to the fact that the disciplinary proceedings are in progress. If that be so, a challenge to the charge-sheet at this stage is impermissible. It goes without saying the petitioner shall be at liberty to challenge the final order (and such orders of the higher authorities) by taking all pleas available to him, both on facts and in law.
