% 16.01.2018 The learned counsel for the petitioner was to seek instruction from the learned arbitrator if he can further reduce his fee from `75,000/- plus 10% clerical charges per sitting to bring it at par with fee schedule under Arbitration and Conciliation Act. The learned counsel for the petitioner referred to an email dated 10.01.2018 sent to the learned arbitrator where he has quantified an amount of `1,95,70,323/- as his claim and the learned arbitrator is agreeable to receive the fee on such quantification, as per the Fourth Schedule of Section 11(14) of the Arbitration and Conciliation Act (Amendment) 2015.

Since there is no dispute qua the fee as the learned arbitrator has agreed to charge the fee as per the Schedule of the Act in respect of the claims quantified per email dated 10.01.2018, hence in view of the above the petition stands dismissed as withdrawn.
