O R D E R
% 24.11.2017 Learned counsel for the petitioner submits that as per the prosecution, petitioner was riding a motorcycle on which co-accused was sitting. Police officials gave signal to motorcyclist to stop. The pillion rider fell down and petitioner fled away from the spot. Pillion rider was chased and he fired at the police party but was finally apprehended. Petitioner was arrested on 24th August, 2016, that is, after about two months of the incident. Petitioner is in custody for more than one year three months.
Learned APP has vehemently opposed the grant of bail to petitioner. It is contended that petitioner had sped away from the spot. He was apprehended after about two months.
He refused to participate in TIP.
Witnesses have yet to be examined. Petitioner is involved in as many as 84 cases.
Learned counsel for the petitioner contends that petitioner has been falsely implicated in 76 cases after his arrest, wherein he has already been discharged. All the witnesses are police officials and they cannot be influenced by the petitioner.
Keeping in mind the totality of the facts and circumstances of the case, it is ordered that petitioner be released on bail subject to his furnishing a personal bond in the sum of `25,000/- with one surety in the like amount to the satisfaction of the trial court.
Bail application is disposed of in the above terms. Dasti.
