% 20.12.2017 On behalf of the State it has been submitted that vide the prayer made by the petitioner seeks quashing of the FIR No.762/2015 under Sections 323/325/34 IPC, 1860, Police Station Adarsh Nagar, however, the charge sheet in the instant case as submitted on behalf of the State has been submitted also under Section 308 read with 34 IPC. It is further submitted on behalf of the State that there is another injured Shivam as detailed in the FIR itself, who is not arrayed as a party to the present petition.

Learned counsel for the petitioner seeks to withdraw the present petition to file it afresh in accordance with law. In view thereof, the petition is dismissed as withdrawn with liberty granted as prayed.
