IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 4101/2017 VIKRAM & ANR ..... Petitioners Through Ms.

Sangeeta Mohanty and Mr.

Masoor Ansari, Advs.

versus STATE & ANR ..... Respondents Through Mr. M.S. Oberoi, APP with SI Kamal Kumar, P.S. Okhla Industrial Area Respondent no. 2 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 06.04.2018 Notice could not be issued to respondent no. 2 as process fee was not filed. However, respondent no. 2 Ms. Pooja is present in Court and accepts notice. She has been identified by SI Kamal Kumar of police station Okhla Industrial Area.

Respondent no. 2 admits having settled the matter with petitioners of her own free will, voluntarily and without any undue force, pressure or coercion before the Mediation Centre, Saket Courts, New Delhi on 5th August, 2017. Respondent no. 2 submits that she is not willing to pursue the FIR any further against the petitioners. Affidavit of respondent

no. 2 is also on record at pages 12-13.

Keeping in view the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No.394/2014 under Sections 354A/509/506/34 IPC registered at police station Okhla Industrial Area and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
