The petitioner-Delhi Jal Board (DJB) is aggrieved by the order dated 30th August, 2016 passed by the Central Administrative Tribunal, Principal Bench, on a petition filed by three employees of the DJB, for issuing directions to DJB to enter their degrees in B.Tech. (Electrical) in their service record and consider them for promotion on the basis of the said degrees along with consequential benefits.

Under the impugned order, the OA filed by the respondents was disposed of at the stage of admission itself without issuing notice to the petitioner/DJB and without going into the merits of the case, with a direction to the petitioners to examine the case of the respondents in the light of the orders dated 13th April, 2011 and 26th May, 2014 passed by the Tribunal in OA No.3741/2009 and OA No.1599/2013, with a further direction that in WP (C) No.9470/2017 Page No.1 of 2

the event the case of the respondents is covered by the aforesaid order, they shall be extended the same benefit as extended to the applicants in the captioned cases.

After addressing arguments for some time, learned counsel for the petitioners states that he may be permitted to withdraw the petition reserving the right of the DJB to raise all the pleas raised in this petition before the Central Administrative Tribunal in the contempt proceedings initiated by the respondents.

Leave as prayed for is granted. The petition is disposed of along with the pending applications.
