O R D E R
% 01.03.2016 This is application under Section 438 of Cr.PC moved by the petitioner for grant of anticipatory bail in case FIR No. 388/2014 under Sections 406/420 IPC registered at Police Station DBG Road, Delhi.
The matter has been settled before the mediation centre and the settlement report has been placed on record. As per the settlement, the amount of Rs.65 lacs has to be paid over a period of 17 years. The first instalment of Rs.20,000/-, which was to be paid by 15.02.2016 has already been received by the complainant. The complainant, who is present in person, states that in view of the settlement arrived at between the parties, he has no objection to grant of anticipatory bail to the petitioner. It is, however, submitted by counsel for the complainant that in case the petitioner fails to abide by the terms and conditions of settlement, he will approach the Court for cancellation of bail.
It is submitted by learned Additional Public Prosecutor for the State that the time for payment of the amount is too long.
Be that as it may, in view of the settlement arrived at between the parties, it is ordered that in the event of his arrest:-
(i) Petitioner be admitted to bail on his executing personal bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount to the satisfaction of the concerned I.O./SHO. (ii) He shall join the investigation as and when called for by the I.O. (iii) He shall furnish his address as well as his contact number to the Investigating Officer.
(iv) He shall not threaten or coerce complainant or any prosecution witness. The application is accordingly disposed of.
