1. The learned Additional Standing Counsel (ASC) for the State informs the Court that Arjun Bhagat, the brother of the Petitioner, who is in judicial custody has applied for bail and that the investigation is progressing in accordance with law. The bail application is fixed for hearing on 8th November, 2017.

2. Counsel for the Petitioner contends that the version of the Respondents that Arjun Bhagat was taken into custody only on 6th October, 2017 cannot to be believed. According to him, he was illegally detained by the Police between 1st and 6th October, 2017. This is, of course disputed by the learned ASC.

3. The question concerning the detention, if any, of Arjun Bhagat between 1st and 6th October 2017 being a disputed one is not being examined in the present petition. The issue is permitted to be raised at the appropriate stage in the proceedings that are underway before the trial Court.
