% 03.03.2016 The present is a petition under Section 407 of the Code of Criminal Procedure, 1973 seeking transfer of Criminal Appeals bearing CA No. 35/14 titled R.K. Gupta vs. DRI and CA No. 53/14 titled Ashok Kumar Verma vs. DRI from the Court of Additional Sessions Judge, Saket Courts, New Delhi to the District & Sessions Judge, Patiala House Courts, New Delhi. The present transfer petition is premised on a public notice dated 22nd October, 2008 issued by Registrar General of this Court vide No. 3089/DHC/Gaz./VI.E.2(a)2008 wherein at Sr. No. 3, it has been clearly directed that the work of Customs, FERA and Directorate of Revenue Intelligence (DRI) shall be dealt with by the criminal courts at Patiala House Courts, New Delhi. The existence and issuance of the afore-stated public notice issued by the Registrar General of this Court is admitted by counsel appearing on behalf of the DRI.

In view of the foregoing, the present transfer petition is allowed. Consequently, Criminal Appeals bearing CA No. 35/14 titled R.K. Gupta vs. DRI and CA No. 53/14 titled Ashok Kumar Verma vs. DRI are transferred

from the Court of Additional Sessions Judge, Saket Courts, New Delhi to the District and Sessions Judge, Patiala House Courts, New Delhi, for further proceedings in accordance with law. The District & Sessions Judge, Saket Courts, New Delhi is directed to transmit the papers and proceedings of the afore-mentioned Criminal Appeals to District & Sessions Judge, Patiala House Courts, New Delhi on or before 23rd March, 2016. The parties shall appear either in person or through their respective counsel before the District and Sessions Judge, Patiala House Courts, New Delhi on 23rd March, 2016 in the first instance in this behalf. With the above directions, the present transfer petition is allowed and disposed of accordingly.

Copies of this order be sent by express messenger to the District & Sessions Judge, Saket Courts, New Delhi to be transmitted to the concerned ASJ, Saket Courts, New Delhi for compliance as well as to the District and Sessions Judge, Patiala House Courts, New Delhi.
