FAO(OS) 517/2015 and CM No. 19082/2015 We have heard the learned counsel for the parties. It now transpires that the only request that has been made is for an early hearing of OMP(I) No. 407/2015 and the Order XXXIX Rule 4 CPC application. The next date fixed before the learned Single Judge is

04.12.2015. We direct that OMP(I) No. 407/2015 as also the Order XXXIX Rule 4 CPC application being I.A No. 17938/2015 be placed before the learned Single Judge in the first instance on 08.10.2015 with the hope and expectation that the learned Single Judge shall take up the matter and dispose it of at an early date. In the meanwhile, the respondent shall file its reply to the Order XXXIX Rule 4 CPC application.

The appeal stands disposed of.
