% 17.01.2018 By this petition the petitioners seek quashing of FIR No.847/2015 under Section 354-D IPC registered at PS G.T.B.Enclave on the complaint of Respondent No.2 and the proceedings pursuant thereto on the ground that the parties have settled the matter.

Learned Additional Standing Counsel for the State on instructions from Investigating Officer submits that in the above-noted FIR, petitioner is the only accused and respondent No.2 the only complainant/victim. As per the Status Report filed it is also revealed that a closure report has already W.P.(CRL) 2860/2017

been submitted on 22nd December, 2017 in the competent court as no evidence came forward to implicate the petitioner in the above noted FIR. Respondent No.2 is present in Court and is identified by the Investigating Officer. She states that she has settled the matter with the petitioner does not wish to pursue the above-noted FIR and the proceedings pursuant thereto.

Petitioner who is present in Court and is identified by the learned counsel affirms the statement of respondent No.2. Since the parties have settled the matter and moreover no evidence has come forward to implicate the petitioner in the above noted FIR; closure report in this regard has already been filed before the competent court, this Court deems it fit to quash the above noted FIR and the proceedings thereto. Consequently, FIR No.847/2015 under Section 354-D IPC registered at PS G.T.B.Enclave and proceedings pursuant thereto are hereby quashed. Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
