% 11.10.2017 After some hearing learned counsel for the petitioner states that she would be satisfied if the petitioner is allowed to remain in Delhi till 30th November, 2017 and regardless of the treatment he would comply with the movement/posting order deploying him with 142 battalion presently at Gandhinagar, Gujrat. Looking at the facts of the present case and as the petitioner's wife is being treated for IVF treatment at Loknayak Hospital, New Delhi, we accept the limited prayer of the petitioner. The movement order would be kept in abeyance till 30th November, 2017. The petitioner would join and report for duty to 142 battalion deployed at Gandhinagar, Gujrat on or before 1st December, 2017.
The writ petition is accordingly disposed of with no order as to costs. SANJIV KHANNA, J.
