The petitioner has filed the present petition, inter alia, praying that directions be given to the respondents to hand over physical possession of the industrial plot bearing No. 214 admeasuring 100 sq. metres in Sector-3, Pocket-L, situated at Bawana Industrial Complex, Delhi, to the petitioner.

The possession of said plot was not handed over to the petitioner in view of a complaint made in the year 2004, to the effect that the petitioner had entered into an agreement to sell for selling the said plot to one Sh Satnam Arora. The petitioner has produced a letter dated 16.08.2013 issued by the Senior Manager (RL), DSIIDC, which indicates that the petitioner was requested to visit the office of DSIIDC on several

occasions commencing from 16.06.2009. It is the petitioner's case that he had visited the office of DSIIDC and met the concerned officials. This is disputed by DSIIDC.

This Court is at a loss to understand as to why in a case where execution of an agreement to sell is admitted, the officers of DSIIDC have repeatedly been asking the petitioner to visit the office and have deferred any action in this regard for the past several years. 4.

This Court is, prima facie, of the view that an inquiry ought to be conducted against the officers of the DSIIDC in this regard. The learned counsel appearing for the respondent seeks time to take instructions and to examine the original file and make submissions. 5.
