The present petition has been filed by the petitioner under Section 226 of the Constitution of India read with Section 482 Cr.P.C. seeking quashing of FIR No.310/2015 under Section 436/2015 PS Roop Nagar on the basis of settlement arrived at between the parties.

I have heard learned counsel the petitioner as well as learned ASC for the State/R-1.

FIR No.310/2015 under Section 436/2015 PS Roop Nagar has been W.P.(CRL) 1998/2015

registered against the petitioner with the allegation that he has set the shop of the complainant/respondent No.2 on fire after pouring kerosene oil. It is also mentioned in the FIR that in the fire, the complainant has suffered huge loss as his entire shop was gutted in the fire. 4.

The FIR in this case has been registered on 24.05.2015 and settlement has taken place within a week i.e. on 31.05.2015. 5.

Looking into the nature of accusations made against the petitioner in the FIR and the manner in which the offence has been allegedly committed i.e. setting the shop of the complainant on fire after pouring kerosene oil, I am of the opinion that it is not a fit case to quash the FIR and criminal proceedings arising therefrom.

The writ petition is dismissed.
