O R D E R

% 01.11.2018 The present appeal is directed against the order dated 04.09.2017 by which an application filed by the appellant for conducting a DNA Test of the younger daughter has been disallowed.

The appellant wishes to withdraw this appeal with a view to avoid any distress to his daughter but without conceding that he is giving up the ground of adultery in case the parties are not able to resolve the matter amicably.

It is also agreed that the respondent will not initiate any proceedings against the appellant after the withdrawal of the appeal and this withdrawal will not come in the way of the appellant at the time of hearing of the appeal.

The appeal is accordingly dismissed as withdrawn with the above observations.
